What constitutes a personal injury case?

I always tell people there’s three elements that we look for when it comes to a personal injury case, regardless of the type. One is liability. It has to be somebody else’s fault. Not your own and somebody that we can really point the finger at that they’ve been negligent. Two, are damages. You need to actually have sustained an injury and evidence, some damages.

Even if somebody acts egregiously and admits fault, but you’re not particularly hurt and you don’t need to seek any medical treatment or really very minimal medical treatment, then the damages would fall short. Lastly, we need somebody who’s going to be able to foot the bill and actually pay your claim, and that’s generally an insurance company.
