What is mediation?

Mediation is a process once in suit where the parties come together outside of a court setting with a mediator and discuss the case and see if they can get their positions closer and potentially resolve the case. This is usually done anywhere from 6 to 10 months into a case after the discovery process has taken place, after a deposition has taken place, and after both parties really understand the positives and negatives of their case and what the other side is looking for. The mediation process is confidential and the mediator does not have authority to make a decision on your behalf. In many cases, a high percentage resolve at mediation if they have not been settled at that point.
